1. Privacy Policy

1.1. Use of your personal information is subject to this Privacy Policy, and is also subject to all applicable laws, including the Privacy Act 1988 (Cth) (the “Act”).

1.2. When you use the https://travel.supercars.com (the “Site”) or contact us, we may collect, use and protect your Personal Information (as defined in the Act) in accordance with this Privacy Policy. This Policy also sets out the type of information we learn about you when you visit the Site and contact us, what we do with that information, how you can change the information we have and your rights in relation to accessing that information.

1.3. “Personal Information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

1.4. References to “us”, “we”, “our” and “Supercars Travel” are references to Sportsnet Corporation Pty Ltd and references to “you” are to you as a visitor to our Site and/or to you who has contacted us. We recognise that your Privacy is extremely important and we are committed to protecting your Personal Information.

1.5. References to “Supercars” are references to V8 Supercars Australia Pty Ltd.

Our Site may contain links to third party websites. We are not responsible for the Privacy policies of any third party websites. We recommend that you review the privacy policy of each website you visit.

2. Collection of Personal Information

2.1. We only collect and retain Personal Information for the purposes of conducting our business as a provider of travel packages, tours and experiences to Australian and international sporting events. We will collect Personal Information from you by lawful and fair means and not in an unreasonably intrusive way.

2.2. The Personal Information we collect from you will include information you give us when you:

  • (a) become a subscriber to our Site;
  • (b) purchase products or services from us;
  • (c) contact us; and/or
  • (d) enter competitions or complete surveys.

2.3. The Personal Information that we collect may include, but is not limited to:

  • (a) your name and date of birth;
  • (b) your contact details including your email, phone number home address and billing address;
  • (c) your payment details; and
  • (d) any other Personal Information that we collect when you place an order on our Site or that you provide to us when you contact us.

2.4. We may collect Personal Information from individuals who are not customers of our business but whose Personal Information is given to us by those individuals via our Site, when they speak with customer services personnel or through competitions and surveys.

2.5. Personal Information we receive from other sources:

We may obtain your Personal Information from other sources. For instance, if you have submitted Personal Information to any third parties that we work with such as payment service providers, credit reference agencies, list brokers and advertising networks, we may receive your Personal Information from them and combine it with Personal Information that you provide to us. We also use a variety of publicly available third-party and general information researched on the internet in order to carry out basic research to enable us to reach out to businesses who we think will be interested in our Site and services. We will only collect corporate contact details (such as business email addresses) when carrying out such research.

2.6. Where you submit Personal Information to us about another person, such as Personal Information about the members of your party for a product that you have purchased on our Site, you must only do so where you have their consent (i) to submit such information to us and (ii) that such information will be handled in accordance with this Privacy Policy. We will use, disclose and store that information in accordance with this Privacy Policy.

2.7. Non-Personally-Identifiable Information collected automatically

2.7.1. We may collect information about you that is not personally identifiable, such as the type of internet browser and operating system you use, or the domain name of the website or the advertisement from which you linked to the Site.

2.7.2. When you visit our Site, we automatically log your IP address. This is the unique address that identifies your computer on the internet and which is automatically recognised by our web server. We use IP addresses to help us administer the Site and to collect data for broad research use. Where possible we link IP addresses to personally identifiable information that helps us evaluate how we might be able to improve our service.

2.7.3. When you view the Site we may store some information on your computer. This information will be in the form of a “Cookie”. “Cookies” are small pieces of information that are stored on your browser on your computer’s hard drive. Our cookies do not contain any personally identifying information, but they do enable us to tailor the Site or advertisement to reflect your interests and preferences. Our use of Cookies is governed by the Supercars Travel Cookie Policy which can be found on this page.

2.8. We will not identify users or their browsing activities, except where required by law or in accordance with our Site Terms and Conditions or our Booking Terms and Conditions.

3. Using and Disclosing Your Personal Information:

3.1. You consent to us using or disclosing your Personal Information collected in accordance with the above, for the following purposes or for a related secondary purpose where you would reasonably expect us to use or disclose the Personal Information for that secondary purpose:

  • (a) to provide you with the information, products and services you have requested from us;
  • (b) to carry out our obligations arising from any contracts entered into between you and us, including for example administering and allocating your ticket to your requested event and/or travel and/or hospitality packages;
  • (c) to provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about. This includes emailing you travel or event information. You may opt out of receiving these marketing emails at any time. We will always take care to ensure that our electronic marketing activities comply with the requirements of the Spam Act 2003 (Cth).
  • (d) to assist with any ticketing queries (including lost tickets) which may arise during an event;
  • (e) if you are a business contact, to provide you with information about our goods and services which we think will be of interest and relevance to you;
  • (f) to manage our relationship with you or your business;
  • (g) to notify you about changes to our services;
  • (h) to develop and carry out marketing activities as noted above;
  • (i) to study how our customers use products and services from us and other organisations;
  • (j) to develop and manage our brands, products and services;
  • (k) to manage how we work with other companies that provide services to us and our customers;
  • (l) to detect, investigate, report, and seek to prevent fraud and other crimes;
  • (m) to obey laws and regulations that apply to us;
  • (n) to respond to complaints and seek to resolve them;
  • (o) to exercise our rights set out in agreements or contracts;
  • (p) to run our business in an efficient and proper way;
  • (q) to administer the Site and the operation of our business;
  • (r) to make improvements to the Site so we can present it in the best possible manner for you;
  • (s) to regulate unauthorised aftermarket ticket sales;
  • (t) for market research and analytical purposes necessary to develop and improve the customer experience at future events;
  • (u) as part of our efforts to maintain the safety and security of the Site, including for the prevention of crime and for supporter security purposes; and
  • (v) to make suggestions and recommendations to users of our Site about products or services that may interest them.

3.2. For the purposes set out above, you acknowledge and consent that we may process and share your Personal Information with personnel of:

  • (a) any member of our group companies, which means our subsidiaries, our ultimate holding company and its subsidiaries and for the avoidance of doubt, includes Sportsnet Corporation Pty Ltd;
  • (b) Supercars who will share ownership of the database of customers of Supercars Travel with us; and
  • (c) other third parties selected by us including:
  • (i.) third-party hospitality providers, Supercars or venue operators of the event you have purchased a package in relation to;
  • (ii.) suppliers and sub-contractors whom disclosure is necessary for the performance of any contract we enter into with them or you (this may include payment service providers, travel service providers, service contractors, and marketing fulfilment partners) or any other data processor who undertakes any data processing on our behalf;
  • (iii.) analytics and search engine providers that assist us in the improvement and optimisation of our site;
  • (iv.) selected IT providers, such as third party cloud platform providers;
  • (v.) credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you;
  • (vi.) any purchaser or prospective purchaser of the shares or business of Supercars Travel, or any purchaser of the Site (and in each case the purchaser shall be entitled to use your Personal Information for the same purposes for which we are entitled to use that information);
  • (vii.) third parties in order to enforce or apply the Site’s terms of use or our terms and conditions of supply;
  • (viii.) advertisers, advertising networks and other third parties chosen by us; or
  • (ix.) third parties in order to protect the rights, property, or safety of Supercars Travel, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

3.3. If those purposes for which we have collected the information involve providing Personal Information about an individual to any third party, we will take appropriate and reasonable steps to ensure any Personal Information is protected.

3.4. You consent to being contacted directly by any of the third parties listed above in clause 3.2 for commercial purposes (for example, to promote their other products and services). You may contact these third parties to opt-out of direct marketing communications from them.

3.5. We may otherwise use and disclose your Personal Information if you have given us consent for the use or disclosure or it is required or authorised by law. If you do not want to receive information from us as described above or wish us to delete or amend Personal Information you have submitted to us please contact us at the address in the “Contact Us” section of this Privacy Policy below.

3.6. You consent to being contacted directly by us for commercial purposes (for example, to promote our other products and services). You may contact us to opt-out of direct marketing communications from us.

3.7. Overseas

3.7.1. We may disclose your Personal Information to recipients set forth above which may be located overseas, which we will do in accordance with applicable laws.

3.7.2. It is possible that Personal Information will be transferred to an overseas recipient (other than any of our overseas related entities) located in a jurisdiction where you will not be able to seek redress under your local data protection laws and that does not have an equivalent level of data protection as in your jurisdiction. To the extent permitted by your local data protection laws, we will not be liable for how these overseas recipients handle, store and process your Personal Information. By providing your Personal Information to us for the purpose of booking and otherwise arranging travel and/ or hospitality related products and services for you, you consent to our disclosure of your Personal Information to these overseas recipients for that purpose.

3.7.2 Other than as expressly set out in this Privacy Policy or as otherwise required or permitted by law, we will not share, sell or distribute any of the Personal Information you provide to us without your consent.

3.7.3. We cannot be responsible for the privacy policies and practices of other web sites even if you access them using links from our Site. Therefore, we recommend you check the privacy policy of each site you visit.

3.7.4. Our customers from the EU are covered by the Principles set out in the GDPR, in addition to this Privacy Policy. The Principles and further information regarding these regulations may be found at www.gdpr-info.eu.

4. Opt-Out or Unsubscribe

4.1. You can easily unsubscribe at any time you want to from our communications by contacting us via the contact details specified in 10 of this Privacy Policy or by following the instructions that you receive from us.

4.2. It may take some time to put an opt-out or an unsubscribe in effect so you may still receive communications from us for several weeks after your request is received.

4.3. For the avoidance of doubt, by opting-out or unsubscribing yourself from a mailing list this will ensure your removal from that particular mailing list but will not guarantee your removal from other mailing lists that we may store your details in as a result of your engagement with a different service or product.

5. Protection and Storage of Your Personal Information:

5.1. We will take reasonable steps to protect the Personal Information we hold against loss, unauthorised access, misuse, interference, modification or disclosure and against other misuse and hold information securely in electronic or physical form in access controlled premises or in electronic databases requiring logins and passwords.

5.2. We will hold your Personal Information on our systems for as long as is necessary for the relevant activity, or as long as is set out in any relevant contract you hold with us. If we have not been in contact with you for 2 years then your account may be classed as dormant or your Personal Information may be deleted in line with our data retention policy. We will email to remind you before deletion so please check your inbox regularly to see if we have sent you any emails about this.

6. Access, correction and other requests in relation to your personal information

6.1. You are entitled to access any Personal Information we may hold about you in accordance with applicable laws, including the Act. Where Personal Information we hold about you is not accurate, complete or up-to-date or the information is irrelevant or misleading, you may ask us to correct that Personal Information, and we will respond to your request within a reasonable time. We reserve the right to confirm the identity of the person seeking access or correction to Personal Information before complying with such a request. We reserve the right to deny you access for any reason permitted under applicable law. If we deny access or correction, we will provide you with written reasons for such denial unless it is unreasonable to do so and, where required by applicable laws, will note your request and the denial of same in our records. 6.2. You must always provide accurate information and you agree to update it whenever necessary. You also agree that, in the absence of any update, we can assume that the information submitted to us is correct, unless we subsequently become aware that it is not correct.

6.3. The privacy laws of some jurisdictions also give individuals the right to delete their Personal Information or, in some circumstances, to restrict or object to the processing of their Personal Information.

7. Information from Third Parties

7.1. During the course of business, we may also collect personal information that is given to them by a third party (for example, a corporate partner of ours or information that is on a publicly maintained record). This information forms part of the personal information described in this Privacy Policy. We will not intentionally solicit personal information that is unintentionally disclosed.

7.2. The information we collect is subject to this Privacy Policy. However, the information collected and stored by the third party remains subject to the third party's privacy practices, including whether the third party continues to share information with us or with other third parties, the types of information shared, and your choices with regard to what is visible to others on that third party's website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected. In addition, we may receive information about you if other users of a third party website or service give us access to their profiles and you are one of their "connections" or information about you is otherwise accessible through your "connections'" web page, profile page, or similar page on a social networking or other third party website or interactive service.

8. Notifiable Data Breaches Scheme

8.1. In the event of any loss, or unauthorised access or disclosure of your Personal Information that is likely to result in serious harm to you, we will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the Privacy Act 1988 (Cth).

9. Consent

9.1. By using the Site you consent to our collection and use of your Personal Information as stated above. If we decide to change our Privacy Policy, we will post a notice to that effect on the Site and such change will be effective from the date on which that notice is posted.

9.2. Our Site may contain chat rooms, forums, message boards, and/or news groups for our users or Members only. Any information that is disclosed in these areas becomes public information and you should always be careful when deciding to disclose your Personal Information.
